Grow Hemp in Pennsylvania

1) How has the 2018 Farm Bill impacted Pennsylvania?

PA’s hemp program began modestly in 2017 (14 research permits, 36 acres). In 2021, the Department issued 426 growing permits (9 research) and 64 processing permits (2 research). With USDA approval, PA now issues permits under the PA Hemp General Permit authorized by the state’s Controlled Plants and Noxious Weeds Act.

2) Updates/changes to PA hemp growing requirements

The following changes benefit growers:

  • Harvest window increased from 15 to 30 days.
  • Allows remediation of non-compliant lots by flower removal or blending to biomass.
  • Negligent violation threshold adjusted to lots testing > 1% Total THC.
  • Only one negligent violation may accrue per season for lots above 1% Total THC.
  • Sample clipping size changed from 2″ floral tip to 5–8″ floral bud.
  • DEA-lab testing enforcement delayed until Jan 1, 2022.
3) What are some uses of hemp?

Thousands of uses including: fiber (paper, plastics, textiles, construction), seed (foods, culinary oils, body care, fuel), and floral/foliar products (CBD extracts). PA continues to evaluate best-fit uses for in-state production and processing.

5) How many permits will be issued in 2021?

No limit. Any application meeting program requirements will be approved.

6) I had a 2020 permit—do I need to apply again?

Yes. Permits expire December 31 each year. 2020 permits were extended through February 2021, but renewal is required. New locations require submitting property information to obtain additional permit numbers.
