Grow Hemp in Michigan
1) Did the hemp grower application fee increase in Michigan? Why?
Yes. The new $1,250 fee for growers is prescribed in Public Act 220 (Industrial Hemp Growers Act, 2020). It replaces the 2019–2020 pilot program fees and aligns with Michigan’s USDA-approved hemp plan (effective Dec 1, 2020). USDA requires the program to be self-supporting (no federal/state tax dollars). Growers should ensure business models cover licensing, sampling, and testing. More: Michigan.gov/IndustrialHemp.
2) Is there a provision to grant exceptions to the grower registration fee based on number of plants or acreage?
No. The fee is a flat amount set in Act 220 of 2020.
3) Does Michigan have testing requirements for CBD?
No. Currently the only required test is THC concentration. All hemp must be sampled and analyzed pre-harvest to confirm compliance. MDARD may also sample finished products (e.g., CBD) to ensure compliant THC levels.
4) Can I use a private lab to monitor THC/CBD? Must labs be licensed?
Labs do not need a special license to test hemp for monitoring. However, per USDA Final Rule (Jan 15, 2021) and PA 220 (as amended), effective Dec 31, 2022 all labs performing THC compliance testing on industrial hemp must be DEA-registered.
