Grow Hemp in Massachusetts

1) Does Massachusetts have a USDA-approved hemp state plan?

Yes. The Massachusetts Hemp Program currently operates under a USDA-approved State Plan (approved under the Interim Federal Rule on May 7, 2020). The state is working to update its plan to incorporate provisions from the USDA Final Rule. Until approval, operations continue under the current plan. Guidance: ams.usda.gov/rules-regulations/hemp.

2) How do I obtain a license to grow or process hemp in Massachusetts?

Individuals or businesses may apply through MDAR for grower, processor, or dual licenses. See the MA Industrial Hemp Program Licensing page for requirements and forms.

3) How much does a license cost?

License Type: Grower / Processor / Dual Grower-Processor

Application Fee: $100 (non-refundable) / $100 (non-refundable) / $100 (non-refundable)

4) Where can I get Department-approved hemp seed?

The Department does not publish an approved vendor list. Seeds must include documentation demonstrating they will produce hemp at ≤0.3% THC to qualify. (Seeds at CBD Seed Labs are 100% USDA compliant.)

5) Is it legal to manufacture delta-8 THC from hemp in Massachusetts?

No. Because delta-8 THC is typically produced synthetically from hemp derivatives, it remains a controlled substance. Hemp-derived delta-8 THC products are not permitted to be processed or sold in Massachusetts.
