1) Does the Cannabinoid Hemp Program permit the sale of cannabinoid hemp flower products?
The proposed regulations permit the sale of cannabinoid hemp flower; however, flower products may not be labeled or advertised for smoking or in the form of a joint, cigarette, cigar, or pre-roll. Flower products not marketed for smoking may be sold by any cannabinoid hemp retail licensee pursuant to the proposed regulations.
2) How do I get a license to process or sell hemp in New York?

3) Difference between “Extracting & Manufacturing” vs. “Manufacturing Only” processor licenses?
Extracting & Manufacturing: May extract/isolate cannabinoids from hemp to create crude, distillate, isolate, or intermediary products and may manufacture final cannabinoid hemp products.
Manufacturing Only: May purchase intermediary products (crude, distillate, isolate, etc.) to manufacture final cannabinoid hemp products; no extraction authority.
4) How do I apply for a hemp grower license in New York?
Each application/renewal must include the Industrial Hemp Grower Application and:
- Description and map for each cultivation location (address + GPS), buildings/structures/uses, and activities at the site.
- Detailed research plan summarizing issues to be studied with cultivation.
- Marketing plan.
- Seed/propagule acquisition plan.
- Statement of relevant experience of the individual responsible for the project.
- Nonrefundable $500 application fee.
