2) Is there a maximum/minimum production size for growing hemp?

The NDA has not implemented any area restrictions related to hemp. You may apply to produce as much or as little hemp as desired so long as the property is appropriately zoned for agricultural production.

3) How can hemp be used and sold?

Hemp is highly diverse—used for fiber, grain, hemp seed oil, CBD oil, and other processed products. If producing/selling CBD products, they must not be marketed with medical/health claims or used as a food ingredient per FDA. Food uses of hemp (non-CBD) may be allowed with local health authority approval; FDA’s restriction applies specifically to CBD products.

4) What do I need to include in a hemp grower application?

The application requires:

  • Location and parcel number
  • Jurisdictional approval & landowner approval
  • Varieties to be planted
  • Proof of land ownership
  • A map of the production area (covering germination through harvest)

All information must be current and all production areas addressed on the map.
